These Terms of Service (“Terms”) govern your use of the Chimebass.com (player.chimebass.com) website, platform, audio library, kids content, wellness audio, artist releases, licensing tools, AI-generated insights, research summaries, and related services (collectively, the “Service”).

The Service is operated by Durant Digital LLC, a Wyoming company (“Company,” “we,” “our,” or “us”).

By accessing or using the Service, you agree to these Terms.
If you do not agree, do not access or use ChimeBASS.

1. Eligibility & Accounts for Minors

1.1 General Use

To use most features of ChimeBASS, users must be at least 16 years old or the legal minimum age in their region.

1.2 Kids Content

ChimeBASS may offer kids-friendly music, calming audio, educational content, and family-safe playlists under “ChimeBASS Kids” or similar branding.

This content is not directed to children under 13 to use independently.

1.3 Parental Consent & Responsibility

If a user is between 13–17 years old, they may use the Service only with permission and supervision from a parent or legal guardian, who:

  • Accepts full responsibility for the minor’s use
  • Agrees to these Terms on behalf of the minor
  • Supervises listening environments (volume, duration, wellness audio, etc.)

Parents/guardians accept that all wellness or calming audio is not medical, therapeutic, or clinical and should not replace professional care.

1.4 Children Under 13

Except for kids content intended for parent-supervised playback, the Service is not intended for independent use by children under 13.
We do not knowingly collect personal data from children under 13 without verifiable parental consent.

If we learn that a child under 13 created an account without permission, the account will be terminated.

1.5 Data Protection for Users Under 16 (CPRA)

In compliance with the California Privacy Rights Act (CPRA) and similar laws, we will never sell or share the personal information of users we know to be under 16 years of age without affirmative opt-in consent from the user (if 13–15) or their parent or guardian (if under 13). This protection applies regardless of the user’s location.

ChimeBASS provides:

  • A library of artist releases and curated playlists
  • Kids-friendly calming music and educational sound content
  • AI-generated wellness insights and focus recommendations
  • Mental health, neuroscience, and well-being research summaries
  • Background audio for productivity, relaxation, and commercial use
  • Affiliate product recommendations
  • Subscription-based access to expanded content

Some features require a paid plan.

3. Accounts & Security

When you register:

  • Provide accurate and complete information
  • Safeguard your credentials
  • Accept responsibility for all activity on your account

If a minor uses your account, you are responsible for their use, safety, and compliance.

You may close your account at any time by contacting support@chimebass.com. Upon closure, we will handle your personal data in accordance with our Privacy Policy and applicable law. EU/UK users may exercise their right to erasure as described in our Privacy Policy.

4. Subscriptions & Payments

ChimeBASS offers subscription tiers for:

  • Music streaming
  • Commercial licensing
  • Kids-friendly content libraries
  • Wellness audio
  • Exclusive artist releases
  • AI insights and research reports

Subscriptions:

  • Renew automatically
  • Are billed through Stripe or app marketplaces
  • Can be canceled at any time
  • Are subject to the Refund & Cancellation Policy

Prices may change with notice for future cycles.

EU/UK Consumer Withdrawal Right: If you are a consumer resident in the EU or UK, you have the right to withdraw from a digital subscription contract within 14 days of purchase without giving a reason, provided that delivery of the digital content has not yet begun. By beginning to access the Service immediately upon purchase, you acknowledge and consent to the immediate performance of the contract and understand that you lose your right of withdrawal once digital content delivery has commenced. You may still cancel your subscription at any time in accordance with our Refund & Cancellation Policy.

5. Music Licensing & Usage Rights

Licensing rights vary by tier and track. Users must comply fully with the license attached to each piece of audio.

You may not:

  • Resell or redistribute audio as standalone files
  • Upload tracks to streaming services as your own
  • Use music to produce competitive audio libraries
  • Train AI or machine-learning models on ChimeBASS audio
  • Use audio for harmful, hateful, or discriminatory content

Violations may result in account termination, legal remedies, and revocation of rights.

6. Kids Content Safety & Limitations

ChimeBASS Kids content is designed for entertainment, calming, and educational environments, not for clinical, therapeutic, or diagnostic use.

We do not provide:

  • Sleep therapy
  • Behavioral therapy
  • Medical diagnosis
  • Developmental evaluation

Adults must:

  • Supervise children’s usage
  • Set safe listening volumes
  • Limit headphone use for young children
  • Ensure proper device access controls

The Company is not liable for misuse or unsupervised use of kids content.

7. Wellness Audio, Research, & AI Insights

The Service provides non-medical audio and AI content, such as:

  • Focus, productivity, and relaxation tracks
  • Mood-based playlists
  • Sound-based wellness recommendations
  • Summaries of neuroscience, psychology, and behavioral research

You acknowledge:

  • These insights are informational only
  • They are not medical, therapeutic, or psychological advice
  • Music and sound responses vary widely
  • No wellness benefit or outcome is guaranteed

Users (or supervising adults) must use discretion.

Automated Decision-Making Disclosure: Some features of the Service — including personalized playlists, focus recommendations, and wellness suggestions — are generated using automated processing of your usage data and content preferences. These recommendations are informational and do not produce legal or similarly significant effects on you. You have the right to opt out of automated processing for recommendations by contacting support@chimebass.com. EU/UK users may also invoke rights under GDPR Article 22 as described in our Privacy Policy.

  • Audio files
  • Artist releases
  • Wellness soundscapes
  • Kids-friendly tracks
  • Website content
  • UI/UX design
  • Brand elements
  • Research summaries
  • AI-generated recommendations

are owned by the Company or its licensors.

You receive only the limited license granted by your subscription tier.

9. Prohibited Conduct

You may not:

  • Scrape, download, or extract content beyond licensed rights
  • Share your account
  • Use the Service for unlawful or harmful purposes
  • Modify, reverse engineer, or circumvent protections
  • Use content to train competing AI models

We may suspend or terminate accounts violating these Terms.

10. Third-Party Services

ChimeBASS integrates with:

  • Stripe
  • External research sources
  • Streaming and audio frameworks
  • Affiliate retailers

We are not responsible for third-party accessibility, data practices, or service reliability.

11. Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • You misuse licensing rights
  • Your payments fail repeatedly
  • You breach safety or content rules regarding minors

Upon termination:

  • Access to licensed content ends
  • All rights granted revert back to the Company
  • No refunds are provided except as required by law

You may also terminate your account at any time by contacting support@chimebass.com. Following termination, we will retain and delete your personal data in accordance with our Privacy Policy. EU/UK users retain the right to request erasure of their data after termination subject to our legal retention obligations.

12. Disclaimers

The Service is provided “AS IS” AND “AS AVAILABLE.”

We do not guarantee:

  • Accuracy of AI insights
  • Wellness results
  • Safety or suitability of kids content for every child
  • Continuous availability of any audio track
  • Error-free operation

Use is at your own discretion.

Force Majeure: The Company is not liable for any failure or delay in performance of the Service resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, internet or infrastructure outages, cyberattacks, pandemics, or actions of third-party service providers.

13. Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for:

  • Wellness outcomes
  • Behavioral or emotional responses to audio
  • Hearing damage from improper listening volume
  • Kids’ unsupervised use of the platform
  • Decisions made from AI insights or research summaries
  • Losses related to licensing misunderstandings
  • Data corruption, downtime, or interruptions

Total liability is limited to the amount paid in the preceding 12 months.

Note for EU/UK/EEA Consumers: Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable mandatory law in your jurisdiction.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

15. Changes to the Terms

We may update these Terms at any time.
Continued use of the Service after changes constitutes acceptance.
