ChimeBASS Terms of Service

Welcome to ChimeBASS! These Terms of Service (“Terms”) govern your access to and use of ChimeBASS websites, applications, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy and Licensing Info.
1. Acceptance of Terms
By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Services.
2. Eligibility
You must be at least 16 years old to use the Services. If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement and consent of a parent or guardian who agrees to these Terms.
3. Account Registration
To access certain features of the Services, you must register for an account. You agree to:

Provide accurate and complete information during registration.

Maintain the security of your account credentials.

Notify us immediately of any unauthorized use of your account.
You are responsible for all activities that occur under your account.
4. Subscription Plans and MyFlow Subscription
ChimeBASS offers multiple subscription plans, including a separate ChimeBass Flow Subscription that grants access to additional features and insights beyond the core audio player.
Subscription Plans:

Free Plan – Stream music with visual advertisements.

Listener Plan – Ad-free streaming, embedding, playlist creation.

Pro Creator Plan – Includes Listener Plan features plus downloads for personal and commercial use, API access.

Business Plan – Includes Pro Creator Plan features plus licensing for background music in commercial spaces (e.g. coffee shops, yoga studios).
ChimeBass Flow Subscription:

A separate subscription that provides access to premium content, health research insights, and immersive experiences on the main ChimeBASS website.

Managed through Stripe. Users are responsible for maintaining the security of their MyFlow account and subscription status.

Subscription status, including activation, billing, and cancellation, is displayed within your account dashboard.
Important: ChimeBASS is not responsible for any delays or interruptions in subscription status due to third-party payment processing (e.g. Stripe). Users are solely responsible for managing their billing information and ensuring payments are current.
For TV broadcast or film sync licensing, please contact us for a custom quote.
5. Licensing and Usage Restrictions
Unless explicitly stated otherwise, all content available through the Services is provided under a non-exclusive, non-transferable license consistent with your chosen subscription plan. You may not:

Use content for TV broadcast, film sync, or other uses not covered by your plan without obtaining a separate license.

Resell, redistribute, or sublicense content as stand-alone files.

Claim ownership of any content provided through the Services.
6. User Conduct
You agree not to:

Use the Services for any unlawful or unauthorized purpose.

Infringe on the intellectual property rights of others.

Interfere with or disrupt the integrity or performance of the Services.

Attempt to gain unauthorized access to the Services or related systems.
7. Termination
We reserve the right to suspend or terminate your access to the Services, including your ChimeBass Flow Subscription, at our sole discretion, without notice, if we believe you have violated these Terms, acted in a harmful or fraudulent manner, or engaged in activity that interferes with other users or our operations.
8. Disclaimers and Limitation of Liability
The Services, including all music content, wellness insights, immersive experiences, and any third-party features such as Stripe-based subscriptions, are provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Services will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, ChimeBASS disclaims all warranties and shall not be liable for any damages arising from your use of the Services. ChimeBASS is not responsible for any third-party content, payment processors, or other external services. Users assume full responsibility for any risks arising from interactions with such services.
9. Dispute Resolution
Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration on an individual basis, in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions or class arbitrations.
10. Changes to Terms
We may modify these Terms at any time. We will provide notice of any significant changes. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
